Upon submitting the order form in any format
(Internet, Fax, E-mail and or by phone), I the client, agree to
all the terms and conditions listed below and will be legally bound
to them as a Client of ACME Logo™. I have reviewed all the
information and accept these terms and conditions without any modifications
and if I do not accept these terms as is, I cannot be a Client of
ACME Logo™. These terms and conditions can be revised and or
updated at anytime with out notice. For this reason we suggest the
Client refers back to this site periodically for any updated information
as this too will be binding to the Client.
- ACME Logo™ will start creation of the Client logo and or
project upon the receipt of the deposit requested of no less than
$3.00. At which time the Client design will be put into the project
flow process. ACME Logo™ will have round one designs to the
Client within 72 business hours.
- Clients who are found terminating the design but using the logos
presented to them after the termination in anyway will automatically
be charged the full amount of $297.00 to the card used to place
the order and/or may be subject to lawsuit for infringement. (see
line 4.)
- During the design process the Client agrees to keep in contact
with ACME Logo™ concerning any revisions, changes, or cancellations.
If the Client fails to contact ACME Logo™ within 30 days,
The Client will then relinquish its rights to ACME Logo's "guarantees"
and will be charged a $100.00 abandonment fee.
- Intellectual Property Rights: All rights and or assignments
will be retained by ACME Logo™ up to the point of final payment.
At which time ACME Logo™ will transfer all rights and or
assignments to the final logo chosen by the Client to the Client.
ACME Logo™ will retain the right to use the Client design
as a show or portfolio piece to promote ACME Logo™ or its
affiliate's products in any way. In the event ACME Logo™
will be forced to defend any unauthorized use of any of its designs
the Client will be responsible for any and all costs incurred.
All concepts and or preliminary materials not chosen or delivered
to the Client or resulting from a project termination will remain
the property of ACME Logo™. These concepts can and may be
resold for other/future designs by ACME Logo™.
- Copyright and or Trademark registration will be the sole responsibility
of the Client. Due to the complexity and variety of Trademark
and Copyright laws, ACME Logo™ cannot be held liable if the
Client is found to be infringing on an already existing Trademark
or Copyright.
- ACME Logo™ shall maintain confidentiality of the trade
secrets and/or confidential information, which the Client provides
to it.
- ACME Logo™ retains the right at any time during the process
to cancel any project for any reason.
- ACME Logo™ reserves the right to deny service to any client
which ACME Logo™ deems inappropriate or offensive such as,
but not limited to pornography, spamming, and racism.
- ACME Logo™ its employees and or any affiliated company
is not liable for any damages or expenses incurred by the use
of its designs or artwork.
- In order for the Client to exercise its right to any guarantee
offered by ACME Logo™ the Client will need to comply with
any and all standards outlined in each of the guarantee offers.
(Please refer to the guarantees for any additional questions.)
- When the Client has agreed on the final product and the project
is completed. The Client agrees to remit the total outstanding
balance of $297 within 2 business days. Upon receipt of this amount
the Client's final design will be delivered electronically to
the clients private viewing page within 24hrs where it can be
accessed by the client at any time with the original e-mail used
to place order and the order number of the project.
- The Client will receive an invoice and transfer of ownership
document by e-mail from ACME Logo™ with in 10 business days
of final payment.
- The Client also agrees to the terms and definitions of all wording
used within the ACME Logo™ site.
- Client agrees that any dispute that arises under this agreement
will be under the jurisdiction of Jefferson County, Colorado.
By submitting your order you are acknowledging your agreement and
consent to all of the information contained in this document. We
